These Terms of Service ("Terms") govern your use of the PixelPop Arcade website. By accessing or using the site, you agree to be bound by these Terms. If you do not agree, please do not use the site.

The service

PixelPop Arcade is a free, ad-supported website that aggregates games from third-party providers, primarily the GamePix network. The games are embedded in our pages via iframes; they are hosted, operated and maintained by their respective developers and providers, not by us.

Permitted use

You may use the site for personal, non-commercial entertainment. You agree that you will not:

• Attempt to interfere with the operation of the site, its games, or its security features.
• Use automated tools (scrapers, bots, etc.) to access the site at a rate that exceeds normal human use, or to harvest content systematically.
• Reproduce, distribute, modify or create derivative works of the site's design, original copy, or assets without our prior written permission.

We may suspend or block access to the site for any user who breaches these rules.

Third-party content and links

The games available on PixelPop Arcade are provided by third parties. While we make a reasonable effort to curate the catalogue, we do not control, endorse or guarantee the accuracy, safety or appropriateness of third-party content. Use of any embedded game is subject to that game's own terms and to the terms of its hosting provider (for example, GamePix).

The site may contain links to other websites. We are not responsible for the content, privacy practices, or terms of those external sites.

Intellectual property

All site code, original written copy, page layouts and visual design on PixelPop Arcade are the property of PixelPop Arcade or are used under licence. Game titles, artwork, characters and other game-related materials are the property of their respective developers and rights holders.

If you believe content on PixelPop Arcade infringes your copyright, please send a takedown notice via the Contact page. Verified, complete requests are actioned within 72 hours.

Disclaimer of warranties

The site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Limitation of liability

To the fullest extent permitted by law, PixelPop Arcade and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the site, the games on it, or any third-party content accessed through it. In all cases, our aggregate liability shall not exceed one hundred US dollars ($100).

Indemnification

You agree to indemnify and hold harmless PixelPop Arcade, its operators, and its affiliates from any claim or demand (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the site.

Governing law
